Bragg Fights Back Against Trump’s Demand to Recuse Judge Amid 2024 Rivalry

Manhattan District Attorney Alvin Bragg has asked Judge Juan Merchan to reject Donald Trump’s request for the judge to step down from the hush money case involving the former president. This information came to light in a court letter made public on Friday.

Bragg’s prosecutors argued that the fact that Vice President Kamala Harris is now Trump’s opponent in the 2024 presidential election is not relevant to the case. They pointed out that Harris had previously hired the marketing services of Judge Merchant’s daughter.

The prosecutors labeled Trump’s request as a “vexatious and frivolous attempt” to revisit an issue that the court had already addressed twice before. This response followed Trump’s latest plea, which was the third request this week for Judge Merchan to recuse himself.

Trump’s legal team contended that his daughter’s job at a leading Democratic marketing firm could lead to a conflict of interest for the judge. However, Judge Merchan had already denied Trump’s previous two requests, stating that an independent panel had determined that Loren Merchan’s work for the firm Authentic Campaigns did not present a conflict.

In his latest request for recusal, Trump argued that Harris’s recent announcement as his opponent heightened the necessity for Judge Merchan to step aside. However, Bragg’s team disagreed with this claim. They stated, “Indeed, defendant rests his latest motion on the same affirmation he presented in support of his April 3 motion. This regurgitated showing does not come close to meeting the standard to renew,” indicating that they believed Trump’s arguments were repetitive and lacked substance.

Loren Merchan is known to be an executive at Authentic Campaigns, a firm that has worked with several Democratic politicians, including Harris, President Joe Biden, and Representative Adam Schiff. Trump’s attorneys highlighted in their recusal request that during her time at Authentic Campaigns, the firm became “the top vendor” for Harris’s unsuccessful 2020 presidential campaign, receiving over $5 million for its services.

Trump’s legal team expressed concerns regarding Judge Merchan’s daughter’s long-standing relationship with Harris, noting that she could potentially gain significant financial, professional, and personal benefits from this connection.

They cited Federal Election Commission records that indicated Authentic Campaigns had received over $12 million in 2024 from various Democratic politicians and groups. They also referred to recent reports stating that Authentic’s founder, who is Loren Merchan’s colleague, is leading an initiative called “White Dudes for Harris,” which has raised millions for Harris’s campaign.

When Harris announced her presidential campaign, her initial advertisement portrayed her as a prosecutor and Trump as a criminal, using her previous experience as a San Francisco district attorney and California attorney general to position herself against him.

Trump’s lawyers argued that Judge Merchan’s decisions in Trump’s case, including an upcoming ruling on Trump’s challenges to his guilty verdict and sentencing, could potentially benefit both Harris and Loren Merchan’s professional ambitions and financial well-being.

In response, prosecutors stated that Trump’s defense team was merely making a series of speculative claims without providing solid evidence to support the notion that Judge Merchan’s family member would gain financially from Trump’s conviction.
