Days after the complaint regarding the August arrest was filed, 33-year-old Donald Mercer resigned from the Cedar Hill Police Department. On Monday, he surrendered himself to the police.

The former officer stopped a 26-year-old woman near 400 East Belt Line Road in August, according to Mercer’s arrest warrant.

She was taken to Midlothian Methodist Hospital for a blood draw after Mercer arrested her for DWI after she failed field sobriety tests and put her in the back of his patrol car.

According to the affidavit, the woman told Officer Mercer she had “marijuana in her pocket” as she was leaving the hospital.

On camera, Texas DPS claims that Officer Mercer allegedly reached into her pocket, kissed her lips and neck, fastened her seatbelt, and drove away.
